All orders are subject to review and acceptance by GrowSmartToys.com. As all prices are subject to change, your order may not be accepted or we may have to communicate price changes or availability issues to you after you place your order. Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. GrowSmartToys.com reserves the right at any time after receipt of your order to accept or decline your order for any reason.

 

UNCONDITIONAL 100% SATISFACTION

We expect our customers to be 100% satisfied with the products we sell and the service we provide. If at any time in the next 30 days you are NOT 100% satisfied, you may send your purchase back for a refund or store credit for the price paid for the merchandise (minus what you paid for shipping), or you may exchange it for another item in our catalog that is more to your liking.

 

ERRORS AND DEFECTS

In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, GrowSmartToys.com shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. GrowSmartToys.com shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, GrowSmartToys.com shall immediately issue a credit to your credit card account in the amount of the charge. In the unlikely event that we've made an error with your order or a product is defective, please call us immediately at 1-281-597-9962 or email us at order@growsmarttoys.com so that we can make it right! In cases of defective merchandise, we may have a replacement shipped direct from the manufacturer, so it's important that you contact us first before returning it.

 

RETURN POLICY AND 30 DAY LIMITED GUARANTEE

Every product you buy from GrowSmartToys.com is backed first by the product manufacturer's or supplier’s warranty. GrowSmartToys.com's 30 day limited guarantee may also apply. We regret we cannot refund delivery charges for returns or exchanges. The customer is responsible for any additional shipping charges associated with an exchange. If merchandise is returned in "as-new" condition within 30 days of purchase, a credit (minus what you paid for shipping) will be issued to the original credit card used for purchasing the item(s) or you can choose to receive a store credit. If merchandise is opened and/or unable to be resold, a store credit will be issued in the form of a GrowSmartToys gift certificate. All returns require a Return Authorization number to be issued prior to being returned. Returned products must be in new condition, include original outer packaging, inner packing materials and other accessories and be received within 30 days of the date shipped. We reserve the right to refuse for return or charge a restocking fee for damaged, incomplete or otherwise non-conforming returns. Returns will not be accepted without a Return Authorization number issued by GrowSmartToys.com or when the product manufactures or distributors return policies supersede ours.

 

LIMITATIONS ON LIABILITY

IN NO EVENT WILL GrowSmartToys.com OR ITS PARENT, AFFILIATES, LICENSEES OR ANY PARTY INVOLVED IN CREATING, PRODUCING OR DELIVERING THE SITE OR ITS PRODUCTS OR SERVICES BE LIABLE IN ANY MANNER WHATSOEVER FOR ANY INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS, USE OR INABILITY TO USE THE SITE, OR IN CONNECTION WITH ANY FAILURE OR PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS OR LINE OR SYSTEM FAILURE (INCLUDING LOSS OF PROFITS, LOSS OF BUSINESS OR DATA, BUSINESS INTERRUPTION, AND DAMAGES THAT RESULT FROM INACCURACY OF THE INFORMATION OR INCONVENIENCE, DELAY, OR LOSS OF THE USE OF THE SITE). THE FOREGOING LIMITATIONS APPLY WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER BASIS, EVEN IF GrowSmartToys.com OR ITS AFFILIATES OR ANY OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
